Governing law

International Trusts Law 1992, as amended 2012 & 2013

Trustee

You must appoint at least one Cyprus-resident trustee supervised by CySEC

Firewall

Only the Cyprus courts can rule on whether the trust is valid

Primary use

Succession anchored in the EU, protection from forced heirship, and structuring wealth across borders

Duration

No time limit since 2012 (the earlier cap was a lifetime plus 21 years)

Protection focus

A statutory limitation period of two years, with a civil rather than criminal burden of proof

This is a general summary only. Cyprus is at its strongest for EU-anchored succession planning, forced heirship protection and tax treaty access. It is not Offshore Broker's first choice where the aim is the shortest possible adversarial creditor window, and whether it suits you depends on the client, the assets, the timing and your home-country law.

01 · Governing law

The International Trusts Law and its amendments

A Cyprus International Trust operates under the International Trusts Law 1992, which the 2012 and 2013 amendments substantially strengthened.

02 · The firewall

The decision rests with a Cyprus court, not a foreign one

When the deed includes a Cyprus choice-of-law clause, the Cyprus courts alone have jurisdiction over the trust's validity and administration.

03 · Limitation period

Fraudulent transfer claims face a two-year window

Within two years, a claimant has to prove both an intent to defraud and actual insolvency at the time of the transfer.

04 · Reserved powers

The settlor can keep clearly defined powers

The deed can reserve powers to revoke or vary the trust, direct its investments or act as protector, and doing so does not make the trust invalid.

05 · Trustee

A trustee based in Cyprus and supervised by CySEC

At least one trustee has to be resident in Cyprus, and neither the settlor nor the beneficiaries may have been Cyprus tax residents in the year before the trust was set up.

06 · Long-term planning

No limit on duration since 2012

In 2012 the old lifetime-plus-21-years limit was removed, which supports genuine multi-generational succession planning recognised across the EU.

Important: Cyprus is built for EU-anchored succession, forced heirship protection and treaty-driven structuring, rather than as a stand-in for the shortest possible adversarial creditor window. Compare the Cook Islands Trust and Nevis Trust when that particular objective comes first. Official sources include the International Trusts Laws 1992 to 2013.

Direct relationships with CySEC-licensed Cypriot trustees — we are not a referral agent

Before we recommend a structure, we compare a Cyprus International Trust against jurisdictions built specifically for asset protection, so that EU-anchored succession planning is never mistaken for commercial-creditor defence.

Fixed fees, with no hidden costs or surprise add-ons

We manage the application, due diligence, deed drafting and trustee process alongside established Cyprus service providers who are supervised by CySEC.

Straight comparison advice — we will point you to the Cook Islands or Nevis when they suit your profile better

We agree the formation scope and fees before any work starts, and we explain trustee charges, third-party costs and ongoing administration clearly during onboarding.

We work across more than 20 jurisdictions, including Cyprus, the Cook Islands, Nevis, the BVI and the Bahamas

If you need an underlying Cyprus company, banking, brokerage or another jurisdiction, we coordinate the wider structure through a single point of contact.

Optional legal and tax advice to keep you fully compliant at home

Where needed, we work with the trustee and legal specialists on reserved powers, appointing a protector, and meeting EU beneficial ownership and reporting obligations.

Structure comparison

The Cyprus International Trust compared with the Cook Islands Trust

Both provide genuine statutory protection, but each was designed with different priorities in mind. The Cook Islands uses a criminal burden of proof and the shortest limitation period available anywhere, while Cyprus brings EU membership, treaty access and reserved powers that no Pacific jurisdiction can match.

Designed specifically for asset protection

Cook Islands Trust

Burden of proofA criminal, beyond-reasonable-doubt standard applies to fraudulent transfer claims.
Limitation periodOne to two years, which is among the shortest of any trust jurisdiction.
Track recordA 40-year record of standing up to direct challenges from US federal agencies, including the FTC and SEC.
EU / treaty accessNone — it is a Pacific offshore jurisdiction sitting outside the EU framework.
EU member state

Cyprus International Trust

Burden of proofA civil standard — the claimant has to prove intent to defraud as well as actual insolvency.
Limitation periodTwo years, counted from the date of the transfer.
EU / treaty accessFull access to the EU single market, plus a double tax treaty network of more than 65 countries.
Reserved powersBy statute, the settlor can keep powers over investment direction, revocation and acting as protector.
Choose Cook Islands ↗For those whose main concern is the strongest possible defence against an active or expected US-style creditor claim.
Choose Cyprus International TrustFor those whose priority is EU standing, forced heirship protection, tax treaty access, or a structure that a European bank will readily recognise.
When the issue is specifically a known or expected commercial-creditor claim, the Cook Islands Trust stays our purpose-built recommendation. Compare Cook Islands Trust
Where Cyprus leads

Standing in the EU and protection from forced heirship

Cyprus is at its most persuasive for EU nationals and residents, and for families with assets or relatives spread across Europe who want a structure that every EU bank and civil-law court will recognise.

EU residents who want protection from forced heirship under their home civil-law regime
Entrepreneurs and investors whose business interests span Europe or the Middle East
International families looking for an EU-domiciled structure for cross-border estate planning
Clients seeking tax-efficient corporate holding structures driven by treaties
When a different jurisdiction is the better fit

Not the option Offshore Broker leads with for adversarial creditor claims

Cyprus does provide a genuine statutory firewall and reserved powers, but it is not designed around the criminal-burden, short-limitation barriers that define the Cook Islands or Nevis.

No criminal, beyond-reasonable-doubt burden of proof — Cyprus works to a civil standard
A two-year limitation period, which is longer than the Cook Islands' one-to-two-year window
Less adversarial case law to draw on than the Cook Islands' 40-year track record
Suitability for commercial-creditor situations has to be assessed before funding
For a known or expected commercial claim, compare the Cook Islands Trust and Nevis Trust. For EU succession and forced heirship planning, Cyprus is often the better fit.
  • Cyprus trustee application coordinated from start to finish
  • Trustee, registration and third-party costs broken out in the written quote
  • Cyprus-compliant trust deed prepared where required
  • Structure registered and prepared to receive trustee-approved assets

What is a Cyprus International Trust used for?

People most often use a Cyprus International Trust for EU-anchored succession planning, forced heirship protection, cross-border estate planning and treaty-driven corporate holding structures. It brings together genuine statutory asset protection and full access to the EU market.

Is a Cyprus International Trust legal?

Yes. Cyprus International Trusts are fully legal structures, used by international families, entrepreneurs and investors throughout Europe. US settlors have to report the trust to the IRS each year on Forms 3520 and 3520-A. Offshore Broker makes sure every structure meets your home-country reporting obligations.

How does Cyprus compare to the Cook Islands for asset protection?

Cyprus gives you a genuine 2012 firewall and a two-year limitation period, but it uses a civil rather than criminal burden of proof, unlike the Cook Islands' beyond-reasonable-doubt standard. If you want the strongest possible adversarial defence, the Cook Islands or Nevis Trust is still the better choice; where Cyprus wins is EU membership and treaty access.

How much does a Cyprus International Trust cost?

We quote pricing on application, and it depends on the structure you need — a standalone trust, or a trust with an underlying Cyprus company and bank account. You get a full, itemised quote before you commit, with no hidden costs.

Can I set up a Cyprus International Trust if I’m already facing a lawsuit?

It depends on the exact circumstances. Under Cyprus law, a transfer made with the intent to defraud a known creditor can still be challenged within two years. If you are already facing legal action, we suggest talking your situation through with us directly.

Can I still access my assets after transferring them to the trust?

In most cases, yes. Cyprus law specifically allows the settlor to reserve powers to direct investments and act as protector without making the trust invalid — which is more permissive than many offshore jurisdictions.

What assets can a Cyprus International Trust hold?

Almost any type of asset — cash, securities, business interests and so on. Real estate is usually held through a Cyprus company that the trust owns, rather than directly, because property always falls under the law of the place where it is located.

How long does it take to establish a Cyprus International Trust?

Once the trustee's due diligence is finished, the trust deed and registration usually take two to four weeks. Opening accounts with Cyprus and European banks adds a further four to six weeks.

Do I need a lawyer to set up a Cyprus International Trust?

We strongly encourage you to get independent legal and tax advice, especially if you are a US person with IRS reporting obligations or an EU-resident settlor working through home-country tax rules. Offshore Broker manages the entire formation process and can put you in touch with qualified advisors.

What is a trust protector and do I need one?

A trust protector is an independent third party — or, under Cyprus's 2012 reforms, potentially the settlor — who holds defined powers, including the ability to remove and replace the trustee. For most Cyprus structures, we recommend including a protector as standard.

What are the annual costs of maintaining a Cyprus International Trust?

Annual trustee administration fees usually fall between $4,500 and $7,000 a year, reflecting the ongoing EU regulatory and compliance obligations. Structures with an underlying company or active banking cost more.
