Protecting Stocks & Investments
Because a US brokerage account sits squarely under the authority of a US court, a judgment creditor can hand the broker a garnishment order straight away – no foreign proceedings, and none of the obstacles a Cook Islands Trust would otherwise put in the way. Shift that same portfolio into an offshore custodial account owned by the trust’s underlying LLC, and it moves beyond that direct reach completely.
In this guide you'll find how securities move into the offshore structure, when to favour an in-kind transfer over liquidation, which custodians tend to suit best, and what running the portfolio looks like once the accounts sit offshore.
The Way a Cook Islands Trust Shields Investment Accounts
When a US custodian holds your brokerage account, it falls squarely inside the reach of a US court. Because the broker is a US entity answerable to US court authority, a judgment creditor need only serve it with a garnishment order, and the account may be frozen or seized with no need to go before a foreign court or to face the obstacles a Cook Islands Trust would otherwise stand between the creditor and the assets. Relocate that same portfolio into an offshore custodial account registered to the underlying LLC - itself owned by the Cook Islands Trust - and the situation shifts completely. The LLC isn't a US entity, and its accounts sit at an offshore institution beyond the jurisdiction of a US court. To get at those assets, a judgment creditor must now file a fresh claim in the Cook Islands, establish beyond a reasonable doubt that the original transfer was fraudulent, do so inside the Cook Islands' one-to-two-year statute of limitations, then fund offshore counsel the whole way through. Confronted with that, most creditors settle or give up before they even begin.
Choosing Between an In-Kind Transfer and Liquidation
There are two routes for securities to enter the offshore structure. The first is in-kind: the positions move from the domestic brokerage account to the offshore custodial account without ever being sold. The second is liquidation: the domestic holdings are sold off, the resulting cash is wired offshore, and the positions get repurchased at the offshore custodian. When cost basis is a concern, the in-kind route is usually the better one. Selling a portfolio that carries significant embedded gains sets off a capital gains tax event in the sale year - the very gains that could have stayed deferred indefinitely had the positions simply been kept. Moving in-kind sidesteps that realisation altogether and keeps the original cost basis intact in the same positions, now sitting with the offshore custodian. The complication is custodian compatibility: not every offshore institution is able to receive and hold every security. Major offshore custodians widely offer US-listed equities, but thinly traded positions, some ETFs, or alternative investments won't necessarily transfer cleanly into every offshore option. Matching the receiving institution's custody capabilities to the actual portfolio before you begin the transfer prevents a forced liquidation the settlor never intended.
Where the Offshore Investment Accounts Sit
For Cook Islands Trust structures, the offshore custodians that come up most often are Swiss private banks, Singapore-based institutional custodians, and the Cook Islands' own banking institutions - each carrying its own minimum account sizes, investment universes, and fee structures. Swiss private banks generally bring the widest securities coverage and the strongest institutional infrastructure, though they ask for higher minimums and a more demanding onboarding. Singapore custodians pair robust technology with a broad Asian equity universe next to US-listed securities. The Cook Islands' own banking institutions - Capital Security Bank in particular - deliver the closest integration with the trust structure, because they concentrate specifically on the Cook Islands international financial services market. Practically speaking, the trustee's existing banking and custodial relationships make the most efficient starting point, because the institution has already run its due diligence on the trustee as a counterparty. Setting up at a brand-new institution from scratch adds several more weeks to the process and brings parallel compliance reviews.
Managing the Portfolio Over Time
With the portfolio now sitting in the offshore custodial account owned by the LLC, the settlor - acting as the LLC's manager - keeps full day-to-day investment authority. Purchasing and selling securities, rebalancing holdings, and making tactical allocation calls all stay under the settlor's direct control as LLC manager, with no need to involve the trustee in routine matters. The trustee watches over the structure and may intervene under the duress clause when a genuine legal threat triggers that authority, but in ordinary circumstances it does not steer investment choices. What this means in practice is that, during normal operation, the offshore structure changes nothing meaningful about how the portfolio is run - the settlor goes on making investment decisions through the very same channels they would use for a domestic account, simply reaching an offshore account instead of a domestic one.

(COMMON QUESTIONS)
Frequently asked questions about Protecting Stocks & Investments
Yes - provided the offshore custodian handles the same securities. An in-kind transfer keeps your cost basis intact and avoids setting off a taxable sale. Check the receiving institution's capabilities against your real holdings before you begin the transfer, and you steer clear of a forced liquidation.
Any positions the offshore custodian is unable to receive have to be sold off first, and the resulting cash is wired offshore and reinvested there. For positions carrying embedded gains, that creates a taxable sale in the year of the transfer.
Yes. Acting as LLC manager, the settlor holds onto full day-to-day investment authority - buying, selling, and rebalancing with no trustee involvement needed for ordinary decisions.
The usual choices are Swiss private banks, Singapore-based institutional custodians, and banking institutions in the Cook Islands - each differing in minimums, security coverage, and fee structures.
No. Because the Cook Islands Trust counts as a foreign grantor trust, every bit of investment income and gains keeps flowing through to the settlor's personal US return just as it did before.
